Status Report of Campaign Finance & Public Disclosure Board Matters




I.          Major Cases/Major Issues:


            Campaign Finance & Public Disclosure Board vs. Minnesota DFL: On December 30, 2002, Judge Lindman ruled in favor of the DFL in this declaratory judgment action. The judgment was entered on January 8, 2003. The DFL then served a motion for attorney's fees on January 29, which was argued to the court on February 27. I filed a Notice of Appeal on March 7, 2003 to prevent the running of the 60-day time for appeal from the January 8 judgment. In view of the pending motion for attorney's fees, the Court of Appeals retained jurisdiction over the appeal, but postponed further proceedings until that motion was decided. Judge Lindman issued an order granting the DFL's motion for attorney's fees in the amount of $24,456 on April 8. I will file an appeal from that order as well, and seek consolidation of both appeals in one proceeding. Our brief on appeal is now due on May 5, 2003.          


            Minnesota Citizens Concerned for Life, et al. v. Kelley, et al. This is a First Amendment challenge to various provisions of Chapter 10A, filed in United States District Court. Plaintiffs served an amended complaint on November 15, 2002, and the State served its Answer on December 4. We are drafting motion papers and a brief in preparation for a summary judgment motion.
