CONCILIATION

AGREEMENT

In the matter of the Elect Brian T. Biele Committee, #15118, District 59B

Pursuant to Minn. Stat. 10A.28, subd. 3, the Campaign Finance and Public Disclosure Board and Brian Biele hereby agree as follows:

1. During calendar year 2001, the Elect Brian T. Biele Committee accepted two contributions from the campaigns of candidates for local office. Contributions from the campaigns of local candidates are prohibited by Minn. Stat. 10A.27, subd. 9 (c). Each prohibited contribution was in the amount of $50. The prohibited contributions were not returned to the contributors within 60 days as required by Minn. Stat. 10A.15, subd. 3.

2. During calendar year 2001, the Elect Brian T. Biele Committee accepted six contributions from political funds, and lobbyists during the legislative session. Contributions from political funds and lobbyists during a regular session of the state legislature are prohibited by Minn. Stat. 10A.273. The total amount of these contributions total $500. The prohibited contributions were not returned to the contributors within 60 days as required by Minn. Stat. 10A.15, subd.

3. In a letter dated January 29, 2002 Brian Biele, stated, " These funds were accepted inadvertently and there was no intent to violate any campaign finance laws or regulations. "

4. The Elect Brian T. Biele Committee registered with the Board on August 4, 1999. This is the first calendar year in which the Elect Brian T. Biele Committee reported acceptance of contributions from prohibited sources or during a regular session of the legislature.

5. The parties agree that the Elect Brian T. Biele Committee accepted two contributions from the campaign committees of candidates for local office and six contributions from political funds, and lobbyists during the regular session of the legislature in calendar year 2001, resulting in inadvertent violations of Minn. Stat. 10A. 27, subd. 9(c) and Minn. Stat 10A.273.

6. Brian Biele hereby agrees to return to donors of the contributions, described in paragraph one, the full amount of the contributions, so as to bring the committee into compliance with Minn. Stat. 10A.27, subd. 9(c). Copies of the checks and the accompanying letters returning the contributions must be forwarded to the Board within 30 days after the date this Conciliation Agreement is signed by the Board Chair.

7. The Board imposes a civil fine totaling $500 to be paid to the Board for deposit in the general fund of the state. The civil fine is equal to one times the total amount of contributions accepted from political funds and lobbyists during the 2001 legislative session.

8. Brian Biele hereby agrees to forward to the Board a total of $500 by check or money order payable to the STATE OF MINNESOTA. The $500 will be paid in five monthly payments of $100, due by the 30th of each month. The fine must be paid in its entirety no later than October 30, 2002. Failure to make a timely installment payment will make the remaining outstanding balance of the fine immediately due. It is agreed by the parties that the payment of the civil fine of $500, and this Conciliation Agreement will be a bar to any civil proceeding under Minn. Stat. 10A.28, subds. 3 & 4.

9. It is further understood and agreed, however, that if the civil fine of $500 is not paid within the time specified in paragraph 8 above, then Brian Biele will be personally liable to pay a civil fine, under Minn. Stat. 10A.28 and 10A.34, subd. 1, in the following amounts:

(a) $1,000, if payment is received 31 to 60 days after October 30, 2002,

(b)   $1,500, if payment is received 61 days to 90 days after after October 30, 2002;

(c)   $2,000, if payment is received 91 to 120 days after after October 30, 2002.

10. It is further understood that if the civil fine is not paid as agreed, within the times specified in paragraphs 8 and 9, the Board will proceed to enforce the provisions of Minn. Stat. 10A.28, subd. 4.

11. It is further understood and agreed that this Agreement is confidential until signed by Brian Biele and the Board Chair; the signed Agreement then shall become a matter of public record, and the statutory requirement of confidentiality shall no longer apply. Minn. Stat. 10A.02, subd. 11 and 10A.28, subd. 3.
